General Provisions
1.1. These Rules for the Purchase and Sale of Goods (hereinafter referred to as the Rules) are a legally binding document for the Parties that establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods from the e-store.
1.2. The Seller reserves the right to change, correct, or supplement the Rules at any time in compliance with the requirements set by legal acts. The Buyer is informed on the e-store website. The Rules applicable at the time of order placement are applied when the Buyer makes purchases in the e-store.
1.3. Persons eligible to purchase from the e-store:
1.3.1. legally capable natural persons, i.e., persons who have reached adulthood and whose legal capacity has not been restricted by court order;
1.3.2. minors aged 14 to 18, only with the consent of their parents or guardians, except in cases where they independently manage their income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above-mentioned persons.
1.4. By confirming the Rules, the Seller guarantees that, according to point 1.3 of the Rules, the Buyer has the right to purchase goods from the e-store.
1.5. The contract between the Buyer and the Seller is considered concluded at the moment when the Buyer, after forming a cart of goods in the e-store, specifying the delivery address, choosing a payment method, and familiarizing themselves with the Seller's Rules, clicks the "Confirm Order" button (see point 5, "Ordering Goods, Prices, Payment Procedure, Deadlines").
1.6. Every contract concluded between the Buyer and the Seller is stored in the e-store.
2. Protection of Personal Data
2.1. The Buyer may order goods in the e-store:
2.1.1. by registering in the e-store, entering the requested data during registration;
2.1.2. without registering in the e-store.
2.2. When ordering goods using the methods specified in point 2.1, the Buyer must provide the personal data necessary for the proper execution of the order in the information fields provided by the Seller: name, surname, delivery address, phone number, and email address.
2.3. By confirming these Rules, the Buyer agrees that the personal data provided in point 2.2 will be processed for the purposes of selling goods and services in the e-store, analyzing the Seller's activities, and direct marketing.
2.4. By agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's e-store, the Buyer also agrees to receive information necessary for executing the order to the email address and phone number provided.
2.5. The Buyer, upon registering in the e-store and ordering goods, undertakes to protect and not disclose login data to anyone.
3. Buyer's Rights and Obligations
3.1. The Buyer has the right to purchase goods in the e-store in accordance with these Rules and the procedures established in other sections of the e-store's information.
3.2. The Buyer has the right to withdraw from the purchase-sale agreement with the e-store by notifying the Seller in writing (via email, indicating the desired item to be returned and its order number) no later than within 14 (fourteen) days from the date of delivery of the item.
3.3. If the Buyer believes their rights have been violated, they must first contact the Seller. If the Seller does not satisfy or partially satisfies the Buyer's request, the Buyer has the right to contact a consumer dispute resolution body. Complaints regarding goods purchased on the Website may be submitted to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, phone: +370 5 262 6751, fax: +370 5 279 1466, website: www.vvtat.lt) or by filling out the application form on the ODR platform at http://ec.europa.eu/odr/.
3.4. The Buyer bears all transportation costs associated with the return of quality goods.
3.5. The Buyer may exercise the right provided in point 3.2 only if the item has not been damaged, its appearance has not substantially changed, and it has not been used.
3.6. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.7. If the registration data provided by the Buyer changes, the Buyer must immediately update them.
3.8. The Buyer undertakes not to transfer their login data to third parties. If the Buyer loses their login data, they must immediately inform the Seller via the contact methods provided in the "Contacts" section.
3.9. By using the e-store, the Buyer agrees to these Purchase-Sale Rules and undertakes to comply with them and not violate the laws of the Republic of Lithuania.
4. Seller's Rights and Obligations
4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the e-shop.
4.2. If the Buyer attempts to harm the stability and security of the Seller's e-shop or violates their obligations, the Seller has the right to immediately and without notice restrict or suspend the Buyer’s ability to use the e-shop or, in exceptional cases, cancel the Buyer’s registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy concerning the Buyer’s personal information specified in the e-shop registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering Goods, Prices, Payment Procedure, and Terms
5.1. The Buyer can purchase goods in the e-shop 24/7.
5.2. The contract becomes effective when the Buyer clicks the "Confirm Order" button, and the Seller confirms the order by sending a confirmation email to the email address provided by the Buyer.
5.3. The prices of the goods in the e-shop and the formed order are indicated in euros.
5.4. The Buyer pays for the goods by bank transfer. This is an advance payment, where the Buyer transfers the necessary payment to the e-shop's bank account after receiving the payment details.
5.5. The Buyer undertakes to pay for the goods immediately. Only after receiving the payment for the goods does the preparation of the shipment begin, and the delivery period is calculated.
6. Delivery of Goods
6.1. When placing an order, the Buyer who selects the goods delivery service undertakes to specify the exact delivery location.
6.2. The Buyer undertakes to receive the goods personally. If the Buyer cannot receive the goods personally but they are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery to the wrong recipient.
6.3. The goods are delivered by the Seller or a representative authorized by the Seller (courier).
6.4. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are approximate and do not apply when the required goods are unavailable in the Seller’s warehouse, and the Buyer is informed of the shortage. The Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to contact the Buyer immediately and agree on the conditions of delivery.
6.5. In all cases, the Seller is released from liability for the violation of delivery deadlines if the goods are not delivered to the Buyer or are delivered late due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
6.6. The Buyer must immediately notify the Seller if the parcel is delivered in a damaged package or if incorrect or incomplete goods are delivered.
6.7. If the Buyer notices damage to the package during delivery, the Buyer must note this in the courier’s delivery document or write a separate report on the damage, in the courier’s presence. If the Buyer fails to do so, the Seller is released from liability for the goods damaged due to packaging issues that the Buyer did not indicate in the delivery document.
7. Product Quality and Guarantees
7.1. The details of each product sold in the e-shop are provided in the product description next to each item.
7.2. The Seller is not responsible if the goods in the e-shop differ in color, shape, or other parameters from the actual appearance of the goods due to the Buyer’s display settings.
7.3. For certain types of goods, the Seller provides a quality guarantee for a specific period, which is specified in the product descriptions.
7.4. If no quality guarantee is specified for certain goods, the guarantees provided for by relevant legal acts apply.
7.5. The Seller provides a 24-month guarantee for all goods unless otherwise specified in the product description.
7.6. The 24-month guarantee applies only to products that maintain their original form at the time of purchase.
7.7. The guarantee does not apply:
- if the product was mechanically or otherwise damaged or disassembled;
- if the defects arose due to the Buyer’s fault through improper storage, maintenance, or use of the product;
- if the product naturally wears out or the defect was disclosed at the time of purchase;
- if any modifications, such as jewelry repairs, are performed on the item.
7.8. The Buyer is informed that jewelry may scratch due to contact with other items or surfaces, and it is recommended to store them separately, avoid contact with sharp objects, and protect them from impacts or other mechanical damages. Such changes are not considered a product quality defect.
8. Buyer’s and Seller’s Responsibility
8.1. The Buyer is fully responsible for the accuracy of the personal data provided. If the Buyer fails to provide accurate personal data in the registration form, the Seller is not liable for the resulting consequences and has the right to claim direct damages from the Buyer.
8.2. The Buyer is responsible for actions performed using the e-shop.
8.3. The Buyer is responsible for protecting their login data. If a third party uses the e-shop with the Buyer’s login data, the Seller will consider this third party as the Buyer.
8.4. The Seller is not responsible for damages arising if the Buyer fails to comply with these Rules, despite having the opportunity to familiarize themselves with them.
8.5. If the Seller’s e-shop contains links to websites of other companies or individuals, the Seller is not responsible for the content or activities on those sites, does not monitor or control them, and does not represent those entities.
8.6. In case of damages, the guilty Party compensates the other Party for direct losses.
9. Marketing and Information
9.1. The Seller may initiate various promotions in the e-shop at its discretion.
9.2. The Seller has the right to unilaterally amend or terminate promotional terms without prior notice. Changes or cancellations apply only from the moment they are enacted.
9.3. The Seller sends notifications to the Buyer using the contact details provided in the registration form.
9.4. The Buyer sends notifications or inquiries using the contact details provided in the “Contacts” section of the e-shop.
9.5. The Seller is not responsible if the Buyer does not receive informational or confirmation messages due to internet connectivity or email service provider issues.
10. Final Provisions
10.1. These Rules are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
10.2. Any disputes arising from these Rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
